Please read these Usage Terms and Conditions carefully before using the GiftBible Service (GBS) provided by Open Gates Life Foundation (hereinafter referred to as “we”,”our”,”us”, or “GBS’ or “OGLF”). By using our service, the user (hereinafter referred to as “you”, “they”, “them”, “their”) agrees to be bound by these Terms and Conditions (T&C). If you do not agree with any part of these T&C, please refrain from using our service.

A1 Service Description

Our facilitation service involves assisting users in packing and posting literature listed in the App to their personal contacts. We strive to provide a reliable and efficient service to meet their shipping needs. However, please note that we act as an intermediary and rely on third-party shipping carriers to deliver the packages.

A2 User Responsibilities

2.1 Eligibility

The user must be at least 18 years old to use our courier service. By availing of our service, you confirm that you have the legal capacity to enter into a binding agreement.

2.2 Accurate Information

You are solely responsible for providing accurate and complete information when using our service. This includes providing correct sender and recipient details and selecting the right book from the list. Any inaccuracies or misrepresentations may result in rejection of your shipment.

2.3 Packaging

You agree to allow GBS to use volunteers to pack the literature securely and appropriately to ensure safe transportation. We will try to provide reasonable packagingto minimize the risk of damage during transit. We are not responsible for any damage caused due to packaging.

2.4 Legal Compliance

You are solely responsible for complying with all applicable laws, regulations, and restrictions regarding the shipment of literature. It is your responsibility to ensure that the contents of the package comply with all local, state, national, and international laws and regulations, including import and export restrictions.

2.5Postal and Courier Services

OGLR will use its descretion to select locally available, cost effective Postel and Courrier Services. You areagreeing to comply with the terms and conditions of the service provider.

A3 Service Limitations

While we strive to offer reliable service, there may be circumstances beyond our control that can affect the delivery of your packages. These circumstances may include but are not limited to natural disasters, strikes, customs delays, or transportation disruptions. We will not be liable for any delays, damages, or losses resulting from such events.

A4 Fees and Payments

A4.1 Service Fees

We offer thebasic service of assisting you in procuring, packing and dispatching your literature free of cost. We arrange literatures and raise sponsorship to cover the cost of transportation.

A4.2 Donations

It costs money to procure literatures and transport to your friends and contacts.  We sincerely request you to donate generously towards these expenses.

Donations can be made by various modes as specified on our website and in the Mobile App.

A5 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of our service. This includes but is not limited to damages for loss of profits, business interruption, or loss of data.

A6 Intellectual Property

All intellectual property rights relating to our service, including but not limited to copyright, trademarks, logos, word mark, content, domain name and any other form of intellectual property, which are registered or un-registered areowned by or licensed to us. You agree not to use, copy, adapt, reproduce, modify, publish, transmit, display or distribute any of our intellectual property or contents without our prior written consent.

A7 Modifications and Termination

We reserve the right to modify or terminate our service or these T&C at any time, with or without any prior notice. It is your responsibility to review these terms periodically for any updates or changes. Continued use of our service after any modifications constitutes your acceptance of the revised T&C.

A8 Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these T&C or our service shall be subject to the exclusive jurisdiction of the Madras High Court.

A9 Severability

If any provision of these T&C is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

A10     Entire Agreement

These T&C constitute the entire agreement between you and OGLF regarding the use of our GBS and supersede any prior agreements or understandings, whether oral or written.
